These Terms & Conditions of Sale (“Terms”) govern all purchases of products, services, and related applications made through www.elysionspa.com (the “Site”).
By placing an order on the Site, you confirm that you have read, understood, and agreed to be bound by these Terms. These Terms constitute a legally binding agreement between Elysion Spa (“we”, “us”, or “our”) and you as the purchaser (“Customer” or “you”).
Elysion Spa reserves the right to amend these Terms at any time without prior notice. The version in effect at the time of order placement shall apply.
1. Scope of Application
These Terms govern the sale of all products, services, digital tools, and online ordering platforms made available through the Site (collectively, the “Products” and “Services”).
2. Order Acceptance & Cancellation
2.1 Order Confirmation
An order confirmation does not constitute acceptance of your order. Acceptance occurs only after verification of payment, product availability, and customer information.
2.2 Right to Refuse or Cancel
Elysion Spa reserves the right, at its sole discretion, to refuse, limit, or cancel any order for reasons including pricing errors, stock limitations, suspected misuse, or regulatory concerns. If payment has been processed, a refund will be issued for the amount paid.
2.3 Customer Cancellation
Customers may cancel an order within 30 minutes of placement. Cancellation requests made after this period may not be accepted.
2.4 Product Availability
We do not guarantee the availability of any Product and reserve the right to discontinue Products at any time without notice.
3. Prices & Payment Terms
3.1 Pricing
All prices are displayed in United Arab Emirates Dirhams (AED) and are valid only within the UAE unless otherwise stated. Prices exclude shipping, handling, customs duties, and taxes, which will be added at checkout where applicable.
3.2 Pricing Errors
While we strive for accuracy, errors may occur. Elysion Spa reserves the right to correct errors and apply the corrected price or cancel the order with a full refund.
3.3 Payment Responsibility
You are responsible for all applicable shipping charges, customs duties, taxes, and payment processing fees.
4. Shipping & Delivery
4.1 Delivery Estimates
Delivery dates are estimates only. Elysion Spa is not liable for delays caused by couriers, customs authorities, or events beyond our control.
4.2 International Orders
For deliveries outside the UAE, the Customer bears full responsibility for customs duties, taxes, tariffs, or import fees.
5. Title & Risk of Loss
Ownership and risk of loss pass to the Customer once Products are handed over to the third-party shipping carrier.
6. Returns & Refunds
6.1 Eligibility
Refunds or exchanges are permitted within 7 days of purchase provided that:
• Products are unused, in original condition, and original packaging
• All accessories are included
• Proof of purchase is provided
6.2 Non-Refundable Items
• Service fees, repairs, and spare parts
• Deposit payments for pre-orders
• Products showing signs of use, damage, or alteration
6.3 Refund Deductions
Original shipping and payment processing fees will be deducted unless the Product is confirmed defective.
6.4 Return Authorization
A Return Authorization Number (RAN) must be obtained prior to return. Shipping costs for returns must be prepaid by the Customer.
6.5 Bundle Offers
Refunds of bundled Products void associated discounts, which will be deducted from the refund amount.
7. Defective or Damaged Products
If a Product is defective or damaged upon receipt, Elysion Spa will, at its discretion, repair, replace, or refund the Product in accordance with UAE Consumer Protection Law.
8. Limited Warranty
8.1 Warranty Period
• Residential use: 12 months
• Commercial use: 6 months
8.2 Coverage
Warranty applies only to manufacturing defects and is valid only for the original purchaser.
8.3 Warranty Service
Customers are responsible for delivering Products to our service center and collecting them after service. For bulky Products, spare parts and repair guidance may be provided.
9. Warranty Exclusions
Warranty does not cover:
• Improper installation or maintenance
• Misuse, abuse, or neglect
• Unauthorized modifications or repairs
• Non-approved parts
• Environmental damage (sun, water, humidity)
• Physical or cosmetic damage
• Consumables (including sauna bulbs, heating tubes, panels)
• Spare parts and repair services
10. Additional Exclusions – Ice Bath & Sauna Products
Warranty excludes:
• Damage from direct sunlight, rain, or extreme weather
• Corrosion caused by sanitization chemicals (including chlorine)
• Transportation damage caused by customer handling
• Water damage to indoor or sheltered-use saunas
11. Safety & Proper Use
Customers are responsible for following all safety manuals, instructions, and warnings provided with the Products. Improper use voids warranty coverage.
12. End-User Sales Only
Products are intended for end-user use only. Unauthorized resale or redistribution is prohibited. Promotional benefits may be revoked if resale activity is identified.
13. Intellectual Property
All Site content, including text, images, branding, and product descriptions, is the intellectual property of Elysion Spa and may not be copied, reproduced, or used without prior written consent.
14. Limitation of Liability
To the maximum extent permitted by UAE law, Elysion Spa shall not be liable for indirect, incidental, consequential, or special damages, including loss of profit or business interruption. Nothing in these Terms limits statutory consumer rights under UAE law.
15. Force Majeure
Elysion Spa shall not be liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, supply chain disruptions, government actions, or transportation delays.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates.
Any dispute arising out of or relating to these Terms shall be resolved by arbitration in Abu Dhabi, administered by the Abu Dhabi Commercial Conciliation and Arbitration Centre (ADCCAC). The arbitral award shall be final and binding.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
17. Consumer Rights
Nothing in these Terms limits or excludes rights granted to consumers under UAE Consumer Protection Law. Where a conflict exists, mandatory UAE law shall prevail.
18. Miscellaneous
• These Terms constitute the entire agreement between the parties
• No assignment without prior written consent
• Invalid provisions do not affect enforceability of remaining terms
• Failure to enforce any provision does not constitute a waiver
